Privacy Policy

1. Information We Collect

We collect information you provide directly:

  • Account data: name, email address, phone number
  • Buyer profile: household size, purchase timeline, financial readiness indicators (income range, down payment range, credit confidence — all self-reported)
  • Documents: W-2s, paystubs, bank statements, and government ID uploaded for pre-approval review
  • Property data: listings you submit, notes, saved searches
  • Messages: communications with your agent and mortgage broker through the platform

We also collect usage data automatically (page views, feature use, device type, IP address) through standard web analytics.

2. How We Use Your Information

  • To provide and improve the BayKey platform and services
  • To enable your licensed agent and mortgage broker to represent you
  • To comply with real estate licensing and mortgage lending regulations
  • To send transactional notifications (approval status, deadlines, offer updates)
  • To comply with legal obligations (DRE record-keeping, NMLS requirements, TRID disclosures)

We do not sell your personal information. We do not use your data for behavioral advertising.

3. Protected-Class Information

BayKey does not collect race, color, national origin, religion, sex, familial status, disability, sexual orientation, gender identity, or any other protected-class information in the home-search or matching process. This is required by the Fair Housing Act and enforced technically — those fields do not exist on our platform.

4. How We Share Information

We share data only as necessary to provide services:

  • Your agent: receives your buyer profile, property submissions, and messages
  • Your mortgage broker: receives financial documents and pre-qualification data you submit
  • Escrow / title: at closing, as required by law
  • Service providers: Supabase (database/auth), Vercel (hosting) — both under data processing agreements
  • Legal compliance: when required by law, court order, or to protect rights

5. Data Retention

Account and transaction records are retained for 7 years following a closed transaction, as required by California DRE regulations. If you delete your account before a transaction closes, we retain only the legally required minimum.

6. Your Rights (CCPA / CPRA)

As a California resident, you have the right to:

  • Know what personal information we hold about you
  • Access a copy of your data (use the “Download my data” button in Settings)
  • Delete your account and data (use “Delete account” in Settings)
  • Correct inaccurate information
  • Opt out of sale or sharing — we do not sell or share for advertising

To exercise any right or submit a verified consumer request, email ai@bayconai.com. We respond within 45 days.

7. Security

We use industry-standard security measures: TLS encryption in transit, encrypted storage at rest, role-based access controls, and row-level security in the database. Sensitive documents are accessible only to you and your licensed professionals.

No system is perfectly secure. Please use a strong, unique password and enable any two-factor options available to you.

8. Children

BayKey is not directed at individuals under 18. We do not knowingly collect data from minors.

9. Changes

We will notify you of material changes to this policy by email or in-platform notice at least 30 days before the change takes effect.
